BACKGROUND:  Some owners and residents of real property that is intersected by the Boundary Line between Albemarle County and Fluvanna County are uncertain as to the location of the boundary line. In order to effectively deliver governmental services and the proper assessment of taxes there is a need to clarify the boundary line between these two Counties. Staff of both counties have reviewed the original 1777 survey of the boundary line and a detailed survey of the southeasterly portion of the boundary line that was performed in 1993 for the Town of Scottsville, as well as contemporaneous Geographical Information System (GIS) maps, and are satisfied that the line can be located with confidence (Attachment A).

STRATEGIC PLAN: Quality Government Operations - Ensure County government’s capacity to provide high quality service that achieves community priorities

DISCUSSION:  In order to enter into agreement with Fluvanna County on the location of the Boundary Line, it will be necessary to receive Board approval for a boundary line adjustment. As ownership is shared between both Counties, both boards would need to authorize this application.  The relevant statute then requires the agreed boundary line be submitted to Albemarle County Circuit Court to be finally established.

BUDGET IMPACT: There is no budget impact associated with this action.

RECOMMENDATION:

Recommendation

Staff recommends that the Board adopt the attached Resolution (Attachment B) authorizing the County Executive to sign any documents required to apply for a Boundary Line Adjustment once the documents are approved as to form by the County Attorney.
