BACKGROUND:  In 1992, Glenmore Associates Limited Partnership conveyed a six-acre parcel to the County and the East Rivanna Volunteer Fire Company for the East Rivanna Fire Station.  As part of the deed, the County and Fire Company also received a two-acre drainfield easement to serve the property and a fifty-foot-wide access easement to the drainfield site.

Rivanna Investment Holdings LLC is now developing the larger 81.703-acre parcel (TMP 93A1-4R) on which the drainfield easement is located.  As part of that development, Rivanna Investment Holdings wishes to vacate the existing easements in exchange for providing the Fire Station with access to the public water and sewer system. 

 

STRATEGIC PLAN: Infrastructure Investment: Prioritize, plan and invest in critical infrastructure that responds to past and future changes and improves the capacity to serve community needs.

 

DISCUSSION:   The connection of the Fire Station to the public water and sewer system was part of an existing “Agreement to Grant Easements,” which the Board previously approved on April 6, 2016.  Though generally consistent with that Agreement, the proposed disposition of the existing drainfield easements was not specifically addressed at that time. Virginia Code § 15.2-1800 requires that the Board hold a public hearing prior to conveying County-owned real property such as these easements. 

 

BUDGET IMPACT: Because the East Rivanna Fire Station will now be served by public water and sewer, no budget impact is expected from the proposed vacation of the existing drainfield easements.

 

RECOMMENDATION:

Recommendation

Staff recommends that, after the public hearing, the Board adopt the attached Resolution (Attachment C) approving the vacation of the two existing easements and authorizing the County Executive to execute any deed(s) or other document(s) needed to vacate the easements once the deed(s) or other document(s) have been approved as to substance and form by the County Attorney.
