BACKGROUND: Beaver Creek Park is a County-owned park whose reservoir provides the sole drinking water supply for the Crozet area. The Rivanna Water and Sewer Authority (RWSA) operates the raw water intake and water treatment facilities. As part of long-term water supply planning, RWSA proposes to construct a new pump station at the reservoir (Pump Station Project).

During review of the related site plan (SDP-2025-00114), the County Engineer determined that approximately 1,000 square feet of fill is required within the floodplain. Under Albemarle County Code ?18-30.3.11, such fill requires a Special Use Permit (SP). The County, as the property owner, must administratively authorize the filing of SP 2026 00005 before the application may proceed.

DISCUSSION: The land agreements between the County and RWSA do not expressly authorize RWSA to submit Special Use Permit applications on behalf of the County. Therefore, the County Executive must sign the SP application as an administrative action. This authorization does not indicate support for or opposition to the Special Use Permit and does not restrict any future review or decision by the Planning Commission or Board of Supervisors.
