BACKGROUND: Pursuant to Virginia Code §15.2-5111, the Board has adopted jurisdictional areas for parcels that may be served by Albemarle County Service Authority (ACSA) water and sewer. The boundaries of the Development Areas generally define the ACSA’s Jurisdictional Area (ACSAJA). The Board of Supervisors must establish and approve changes to the ACSAJA.
The provision of water and sewer service is a key tool for implementing the County’s Growth Management Policy. AC44 provides the following guidance concerning the provision of water and sewer service in the Community Facilities and Infrastructure chapter:
Objective 2: Provide access to public water and sewer in the Development Areas and county
consistent with the Growth Management Policy.
Action 2.1: Use the Development Areas boundaries to guide the ACSA Jurisdictional Area for
the provision of public water and sewer.
Action 2.1 also states that changes to the ACSAJA boundaries outside of the Development Areas should only be considered when:
(1) the area to be included is adjacent to and can be served by existing lines;
(2) public health is in danger/at risk; and
(3) on-site private water/septic utilities are cost prohibitive or not technically viable.

DISCUSSION: The owner of Tax Map Parcel 04700000000100 (TMP 47-1) is seeking to establish a religious assembly use of not more than 200 persons. The proposed religious assembly use is by-right and exempt from the requirement for a site plan, but a concept plan has been provided in conjunction with a special exception for a critical slopes waiver, SE-2026-00001 (Attachment A).
TMP 47-1 has an existing residence served by well and septic (see Attachment B). The property owner is requesting ACSAJA designation for water and sewer service to serve the religious assembly use.
A detailed staff analysis is provided in Attachment C.
Staff believes applicable factors are sufficiently met and recommends providing limited water and sewer service to TMP 47-1 for the proposed religious assembly building (Attachment D). This level of service would provide public water and sewer to the proposed religious assembly use. The existing residence would continue to be served by its existing well and septic system.
BUDGET IMPACT: There is no direct budget impact from this request. The property owner would bear the cost for water and/or sewer connections.
RECOMMENDATION:
Staff recommends that the Board adopt the resolution (Attachment E) to approve the proposed amendment to the ACSAJA for limited water and sewer service to the proposed religious assembly use only.
