BACKGROUND:  The Board authorized condemnation of portions of Parcel Nos. 061M0-00-02-00100 and 061M0-00-01-00600 (Parcels) on June 18, 2025, to advance the Commonwealth-Dominion Drive sidewalk improvements project.  At that time, the County and the property owner, Sue Albrecht, were unable to agree on just compensation for the required portions of the Parcels.  The County filed a Certificate of Take and a Petition in Condemnation to acquire the necessary portions of the Parcels for the Commonwealth-Dominion Drive sidewalk improvements project.  At the same time, the County continued to negotiate with Ms. Albrecht to settle the matter, as authorized by the Board’s condemnation resolution.

STRATEGIC PLAN: Infrastructure & Placemaking - Invest in infrastructure and amenities that create connection, opportunity, and well-being.

DISCUSSION:  Prior to pursuing condemnation for portions of the Parcels, the County’s final offer to Ms. Albrecht was $10,500.  After condemnation paperwork was filed, Ms. Albrecht contacted the County to settle the matter for $25,875.  Through continued negotiations, Ms. Albrecht and the County, based on advice from outside counsel, reached a settlement price of $15,000, subject to Board approval.  Board approval of the settlement price will limit litigation costs and expedite resolution of the condemnation proceedings.  Upon advice of outside counsel, staff recommends approval of the settlement price.

BUDGET IMPACT: There is no budget impact associated with this item.  This project is funded through the Virginia Department of Transportation, and the cost for the settlement price is in the project contingency budget.

RECOMMENDATION:

Recommendation

Staff recommends the Board adopt the attached Resolution (Attachment A) authorizing the County Executive to approve the settlement price and sign all documents necessary to resolve this matter once approved as to form and substance by the County Attorney.
